LUVAYNE Terms of Service

1. What this agreement covers

These terms are between you and İlkin Reha Öztürk, who operates LUVAYNE (see section 17 for contact details). They cover the LUVAYNE iOS app and everything in it.

By using LUVAYNE you agree to these terms. If you do not agree, do not use the app.

2. You must be 18 or over

LUVAYNE is an adult product. You may use it only if you are 18 or older and are an adult in the place where you live.

You confirm your age when you first open the app. We do not verify it. If we learn that an account belongs to someone under 18, we will close it and delete its data.

3. Your companion is not a person

Every companion in LUVAYNE is artificial intelligence. She is a fictional adult character generated by a language model.

  • She is not a person, and no human being is reading or answering your messages.
  • She is not a therapist, doctor, lawyer, or crisis service, and nothing she says is medical, legal, financial or psychological advice.
  • She can be wrong. She can misremember. She can say things that are not true.
  • She cannot call anyone for you, cannot contact emergency services, and cannot act in the physical world.

If you are in danger or thinking about harming yourself, contact your local emergency number or a crisis line. Do not rely on the app. What the app does in that situation is described in SAFETY.draft.md.

4. Your account

Accounts are created with Sign in with Apple. It is the only sign-in method. One account is for one person; do not share it, sell it, or let anyone else use it.

You are responsible for what happens under your account.

You can delete your account at any time from Settings. Deletion is permanent: your conversations, memories and relationship state are removed from our servers. Purchase records held by Apple and by our payment verification provider remain under their own policies.

5. What you may do

LUVAYNE is built for adult romantic and sensual conversation with a fictional adult character: flirting, adult romance, sensual dialogue, jealousy, dating roleplay, seductive conversation, adult suggestion, and consensual adult roleplay between you and a fictional adult character. The companion is not meant to refuse those things reflexively.

The app operates within the App Store's content rules. It stops short of explicit anatomical description of sexual acts. That is a product boundary, not a judgement about you.

6. What you may not do

The following are prohibited absolutely. They are not a matter of taste or settings, and the app enforces them in the model, in server-side policy checks and in automated screening of generated images.

You may not use LUVAYNE to solicit, produce, or attempt to produce:

  • Anything sexual involving a minor. This includes characters who are minors, characters whose age is ambiguous in a sexual context, and any roleplay that positions you or the companion as a minor.
  • Sexual exploitation.
  • Non-consensual sexual content.
  • Sexual violence.
  • Sexual deepfakes of a real person without their consent — including attempts to make a companion depict, impersonate or be sexualised as an identifiable real individual.
  • Any sexual content that is illegal where you are or where we operate.

You also may not:

  • attempt to bypass the app's safety behaviour, its content boundaries, or its age gate, including by prompt injection or by instructing the companion to ignore its rules;
  • use automated tools, scripts or bots against the service, or attempt to generate content at machine scale;
  • attack, probe or overload the service, or attempt to reach another user's data;
  • resell, redistribute or commercially exploit anything the app generates for you in a way these terms do not allow;
  • use the app to harass, threaten or defame anyone.

If you break these rules we may limit, suspend or terminate your account. For the prohibitions in the first list we may do so immediately and without notice.

7. Subscription (LUVAYNE Premium)

  • Price: $12.99 per month, or $79.99 per year. Prices in other countries are set by Apple's price tiers and shown in the app before you buy.
  • No free trial. Premium starts when you pay.
  • Auto-renewal. A subscription renews automatically at the end of each period unless you turn renewal off at least 24 hours before it ends. Apple charges your Apple Account.
  • Cancelling. You manage and cancel the subscription in your Apple Account settings, not in LUVAYNE. Cancelling stops the next renewal; it does not end the period you already paid for.
  • What it gives you: conversation without the daily free-tier limit (subject to a server-side daily fair-use ceiling), full memory, and proactive morning and night messages. It also gives you the monthly media allowance and monthly Credits described in section 8. Premium does not make photos, voice notes or calls unlimited.
  • Entitlement is server-verified. Access turns on after our server verifies the purchase, not at the moment the store accepts it.

8. Credits, the monthly allowance and the monthly bonus

LUVAYNE has three separate balances. They behave differently, so read this part.

1. Credits you buy. Consumable credit packs bought in the app. Purchased Credits never expire. They stay yours if you cancel Premium and if you never subscribe at all.

2. Your monthly Premium media allowance. While a paid Premium period is active, you receive a monthly allowance for photos, voice notes and calls. It is one shared pool: taking a photo also reduces the call time available, and vice versa. It resets each month and does not roll over. It ends when the subscription ends.

3. Your monthly Premium Credits. While a paid Premium period is active, you also receive a monthly amount of Premium Credits. These reset each month and do not roll over — unused Premium Credits do not accumulate. The app shows you the date they renew. They are removed when the subscription ends. Credits you bought are not touched.

When you use a paid feature, the cost comes out of the monthly allowance first, then your monthly Premium Credits, then the Credits you bought.

Other terms:

  • Prices in Credits for each feature, and the number of Credits in each pack, are shown in the app at the moment of purchase and confirmed by our server. They may change; a change never reduces Credits already in your balance.
  • Credits have no cash value, cannot be exchanged for money, cannot be transferred between accounts, and are not a payment instrument.
  • Occasional launch or introductory offers may be limited in time or to one purchase per account. The app states the limit on the offer itself.
  • If a paid action fails to deliver, the Credits reserved for it are returned.
  • Bond and relationship progress cannot be bought.

9. Payment and refunds

All purchases are made through the App Store and charged by Apple to your Apple Account. We never receive your payment details.

Refunds are handled by Apple under Apple's Media Services Terms and Conditions. Request a refund through Apple. We cannot issue refunds for App Store purchases ourselves, and we cannot reverse an Apple decision.

If Apple reverses a purchase, we may remove the corresponding Credits or access.

10. Content

What you write. You keep whatever rights you have in your own messages. You give us permission to store and process them so the service can work — to generate replies, keep memories and continuity, and operate the app. Sending your conversation to our AI provider needs your separate permission, and keeping conversations to train our own model needs another, optional one. See the Privacy Policy.

What she writes and what the app generates. Replies, generated images and generated audio are produced by machine learning models. For your personal, non-commercial use of the app, you may keep and view them. We make no claim that generated output is original, unique to you, or protected by copyright, and different countries treat AI-generated output differently. Do not use it as though it were a photograph of a real person, and do not present it as a real person's likeness or voice.

Our material. The LUVAYNE name, the app, its characters, artwork, and written material are ours. Do not copy or reuse them outside the app.

11. Availability, changes and beta status

We may change, suspend or discontinue any part of the service. Features may break, and models and providers may change. We do not promise uninterrupted availability, and we do not promise that a given companion, feature, price or Credit rate will exist forever.

If we discontinue the service entirely, we will give reasonable notice and a way to export your data.

12. Disclaimers

The service is provided "as is" and "as available", to the fullest extent the law allows. We do not warrant that the companion's output is accurate, appropriate, or fit for any purpose, and we do not warrant that the service will be uninterrupted or error-free.

LUVAYNE is entertainment. It is not a substitute for human relationships, and it is not a substitute for medical, mental-health, legal or emergency services.

Nothing in these terms excludes liability that cannot be excluded by law — including, where applicable, liability for death or personal injury caused by negligence, for fraud, and consumer rights that cannot be waived.

13. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or loss of goodwill.

To the extent the law allows, our total liability for any claim connected to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or USD 100.

14. Termination

You may stop using LUVAYNE at any time and delete your account from Settings.

We may suspend or terminate your account if you break these terms, if we are required to by law, or if we discontinue the service. If we terminate your account for a reason that is not your breach, and you have unused purchased Credits, contact us.

Sections 10, 12, 13 and 16 survive termination.

15. Changes to these terms

We may update these terms. If a change is material we will tell you in the app before it takes effect. Continuing to use LUVAYNE after that means you accept the new terms. If you do not accept them, stop using the app and delete your account.

16. Governing law and disputes

These terms, and any dispute arising from them, are governed by the laws of Türkiye. Any dispute that cannot be resolved informally between you and us is subject to the exclusive jurisdiction of the courts of İzmir, Türkiye.
